A “no work, no pay” rule will be applied on Saturday, January 25, 2020, following President Duterte’s declaration of a special nonworking holiday for the celebration of the Chinese New Year.
In its issuance, the Department of Labor and Employment (DOLE) said only employees who will be on duty during the holiday will get paid “unless there is a favorable company policy, practice, or collective bargaining agreement [CBA] granting payment on a special nonworking day.”
“For work done during the special day, he/she shall be paid an additional 30 percent of his/her wage on the first eight hours of work,” Labor Secretary Silvestre H. Bello III said in Labor Advisory 2.
The labor chief said employees will get an additional 30 percent of their hourly rate during the special holiday if they will work overtime, and another 50 percent of their daily pay if the day coincides with their day off. “The pay rules for January 25, special nonworking day is pursuant to Proclamation No. 855 issued by President Rodrigo Roa Duterte,” Bello said.
He urged the employers to comply with the said pay rules to avoid complaints from their employees.
Chinese New Year is a Chinese festival celebrated worldwide to commemorate the start of the new year in the traditional Chinese calendar.
