(UPDATED) – The National Irrigation Administration (NIA) has lifted its blacklisting order on two of three project contractors for failing to “fully and faithfully” comply with their contractual obligations over construction and improvement of dams.
Mac Builders, project contractor of the P730.945-million Malinao Dam Improvement Project, has now been placed under the status of “Temporarily Removed Blacklisted Entities” as cited in the website of the Government Procurement Policy Board (GPPB).
Also removed temporarily from the blacklist was Premium Megastructures Inc., per the GPPB website.
The Ormoc City, Leyte-based Premium Megastructures is the contractor of the P273.508-million Bonot-Bonot Earthfill Dam and its appurtenant structures located in the municipality of Buenavista Bohol, according to NIA.
In February 2021, the NIA had announced it placed Mac Builders and Premium Megastructures –along with the consortium of ITP Construction Inc. and Guangxi Hydroelectric Construction Bureau Co. Ltd –on a blacklist for their failure to comply with their respective contracts.
The blacklist was in effect from January 28, 2021 to January 27, 2022, the NIA said then in an official statement sent to media.
On top of the blacklisting, NIA had said in February a total of P2.060 billion of performance securities by the three contractors has been forfeited in favor of the government, pursuant to the penalty provisions stipulated under Republic Act 9184 or the Government Procurement Act.
“The blacklisting of the three contractors was made in penalty to their failure to fully and faithfully comply with contractual obligations without valid cause or non-compliance to any written lawful instruction of the procuring entity or its representative[s] pursuant to the implementation of the contract,” NIA said in its February 2021 announcement.
“Other violations under Annex I of the Revised Implementing Rules and Regulations [IRR] of RA 9184 include the absence of minimum essential equipment listed on the bid. The said equipment is necessary to prosecute the contract works in accordance with the approved work plan and equipment deployment schedule as required for the project,” NIA added.
“ITP/Guangxi Construction [Consortium], with principal address at 10 Dao Street, Project 3, Quezon City, is the project contractor of P5.863-billion Balog-Balog Storage Dam and its appurtenant structures under the Balog-Balog Multipurpose Project-Phase II [BBMP-II] located in Barangay Maamot, San Jose, Tarlac,” NIA said.
