THE first Philippine branch of Toyoko Inn Cebu has been advised to momentarily cease the operation for operating without a certificate of occupancy.
The hotel located at J Center Mall along A.S. Fortuna Street, Bakilid, Mandaue City, on April 28, 2017.
The Office of the Building Official (OBO) has issued the notice and informed the hotel management through Jerry Uy of their violation.
OBO acting chief Andres Suson cited Section 212 of Presidential Decree 1096, otherwise known as the National Building Code, which provides for the “use or occupancy of a building/structure without certificate of occupancy/use even if constructed under a valid building permit” as being violated.
Suson said this violation falls under less grave violation with corresponding fine.
He said the building official is mandated to enforce the provision of the Code and its implementing rules and regulations.
“It is for this reason that you are hereby advised to momentarily cease the operation until such time that you can secure a certificate of occupancy,” read Suson’s letter dated June 1, 2017.
Suson endorsed the letter to Mandaue City Legal Officer Omar Redulla to serve the cease order.
“Please be informed that this office does not have any ‘legal section’ and personnel to handle any legal procedures in dealing with all the violators of PD 1096, also known as the National Building Code of the Philippines,” read Suson’s endorsement dated June 7, 2017.
Since then, Mandaue City Mayor Gabriel Luis Quisumbing has not yet acted on the OBO’s recommendation and the hotel continues to operate.
The hotel offers 582 guest rooms in an 18-story building.
Toyoko Inn Cebu is a joint venture of Toyoko Inn Co. Ltd. and Everjust Realty Development Corp.
Currently, there are 170 employees working for the hotel.
